1. Agreement to terms

These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("you," "your," "Customer," "User") and SASProductions LLC, a North Carolina limited liability company also registered to do business in the State of Florida, operating shootingastargear.com under the brand "Shooting A Star Gear" ("SASProductions," "we," "us," "our"), governing your access to and use of shootingastargear.com (the "Site"), our products, and any related services (collectively, the "Services").

By accessing the Site, creating an account, placing an order, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, Refund & Returns Policy, Shipping Policy, and Warranty Policy, each of which is incorporated by reference.

If you do not agree to these Terms, you must not access or use our Services.

2. Eligibility

To use our Services, you must:

  • Be at least 18 years of age, or the age of legal majority in your jurisdiction, whichever is greater
  • Have the legal capacity to enter into a binding contract
  • Not be prohibited from using our Services under applicable law (including US trade sanctions and export controls)
  • Provide accurate, complete, and current information when creating an account or placing an order

If you are using our Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

3. Account registration

You may browse our Site without creating an account, but certain features (order history, saved addresses, faster checkout) require account registration.

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately at support@shootingastargear.com of any unauthorized access or security breach

We are not liable for any loss or damage arising from your failure to safeguard your account credentials. We reserve the right to suspend or terminate any account at our discretion for violation of these Terms, suspected fraud, or any conduct we believe is harmful to other users, our business, or third parties.

4. Products and services

4.1 Product descriptions and accuracy

We strive to display product descriptions, images, specifications, and pricing as accurately as possible. However:

  • We do not warrant that product descriptions, images, colors, or other content are accurate, complete, current, or error-free
  • Product images are for illustrative purposes — actual products may vary slightly
  • We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice

4.2 Product availability

All products are subject to availability. We reserve the right to:

  • Limit quantities of any product
  • Discontinue any product at any time
  • Refuse or cancel any order, including orders that have been confirmed and charged

If a product becomes unavailable after your order is placed, we will notify you and issue a full refund or offer a comparable substitute at our discretion.

4.3 Product use

Products sold through our Site are intended for the uses described on the product page. You are responsible for using products in accordance with manufacturer instructions, applicable laws, and reasonable safety practices. We are not liable for damages or injuries resulting from misuse, modification, or use of our products outside their intended purpose.

5. Pricing and payment

5.1 Pricing

All prices displayed on the Site are in US Dollars (USD) unless otherwise stated. International customers may see prices converted to local currency for reference, but all transactions are processed in USD or the customer's selected market currency, where applicable.

We reserve the right to change prices at any time without prior notice. The price applicable to your order is the price displayed at the time you complete checkout.

5.2 Payment methods

We accept payment via methods displayed at checkout, which may include credit/debit cards, PayPal, Shop Pay, Apple Pay, Google Pay, and other approved methods. By providing payment information, you represent that:

  • You are authorized to use the payment method
  • The payment information is accurate and current
  • You authorize us (or our payment processor) to charge the full order amount, including taxes, shipping, and any applicable fees

5.3 Taxes

Sales tax, VAT, GST, and other applicable taxes will be calculated and added at checkout based on your shipping destination. You are responsible for any taxes, duties, or fees not collected at checkout, as described in our Shipping Policy.

5.4 Order acceptance

Your order constitutes an offer to purchase. We reserve the right to accept or reject any order for any reason, including:

  • Suspected fraudulent activity
  • Inability to verify payment information
  • Inaccuracies in product or pricing information
  • Limits on quantities available for purchase
  • Suspected violations of these Terms

If we cancel an order after payment has been processed, we will issue a full refund.

5.5 Promotional codes and discounts

Promotional codes, discounts, and offers are subject to the specific terms displayed at the time of the promotion. Unless otherwise stated:

  • Codes cannot be combined with other offers
  • Codes have an expiration date and are non-transferable
  • We reserve the right to cancel, modify, or revoke any promotion at any time
  • Discounts cannot be applied retroactively to completed orders

7. Intellectual property rights

7.1 Our intellectual property

All content on the Site — including text, graphics, logos, images, photographs, videos, audio clips, software, product designs, and the overall look and feel of the Site — is the property of SASProductions LLC or its licensors and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

The "Shooting A Star Gear" name and logo are trademarks of SASProductions LLC, with federal trademark registration in process with the United States Patent and Trademark Office (USPTO). Common-law trademark rights are claimed and reserved.

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any of our content without our prior written permission, except:

  • For your own personal, non-commercial use
  • To temporarily store copies in your browser cache
  • To print a single copy for personal reference

7.2 User-generated content

By submitting reviews, photos, comments, suggestions, or other content to our Site or social media channels ("User Content"), you:

  • Represent that you own or have the necessary rights to the content
  • Grant us a perpetual, irrevocable, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, distribute, publicly display, and create derivative works from your User Content for any purpose, including marketing and promotional use
  • Waive any moral rights to the extent permitted by law
  • Acknowledge we have no obligation to publish or use your User Content

You are solely responsible for your User Content and any consequences of submitting it. We reserve the right to remove any User Content at our discretion.

7.3 Prohibited User Content

You agree not to submit User Content that:

  • Is unlawful, defamatory, obscene, abusive, threatening, or harassing
  • Infringes the intellectual property rights of any third party
  • Contains personal information of others without their consent
  • Promotes illegal activity or violates these Terms
  • Contains malware, viruses, or harmful code
  • Is misleading, false, or designed to deceive other customers (including fake reviews)

8. Acceptable use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Services in any way that violates applicable federal, state, local, or international law
  • Use the Services to defraud, deceive, or mislead any person or entity
  • Attempt to gain unauthorized access to our systems, accounts, or data
  • Interfere with or disrupt the Services or servers connected to the Services
  • Use any automated system (bots, scrapers, crawlers) to access the Services without our prior written permission
  • Reverse engineer, decompile, or attempt to extract source code from the Site
  • Use the Services to transmit unsolicited advertising or spam
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Engage in any conduct that restricts or inhibits another user's enjoyment of the Services
  • Use the Services for competitive intelligence, benchmarking, or to develop a competing product

We reserve the right to investigate and take legal action against anyone who violates this section, including referral to law enforcement.

9. Chargebacks and payment disputes

If you have a concern with a purchase, you agree to contact us first at support@shootingastargear.com to attempt resolution before initiating a chargeback with your bank or card issuer.

Initiating a chargeback without first contacting us, or initiating a fraudulent chargeback (a chargeback for goods that were received and not returned), constitutes a material breach of these Terms and may result in:

  • Suspension or termination of your account
  • Permanent ban from future purchases
  • Recovery of the disputed amount through collection action
  • Reporting to fraud prevention databases (e.g., Ethoca, Verifi)
  • Reimbursement of chargeback fees and reasonable attorney's fees

We respond to all legitimate chargeback inquiries within timeframes required by Visa, Mastercard, American Express, Discover, and PayPal.

10. Account suspension and termination

We reserve the right to suspend, restrict, or terminate your account or access to the Services at any time, with or without notice, for any reason, including:

  • Violation of these Terms or any incorporated policy
  • Fraudulent, abusive, or illegal activity
  • Failure to pay any amount owed
  • Conduct that we believe is harmful to other users, our business, or third parties
  • Inactivity for an extended period
  • Compliance with legal obligations or government requests

Termination of your account does not relieve you of any obligation to pay outstanding amounts or limit our ability to pursue any remedies available to us.

You may terminate your account at any time by contacting support@shootingastargear.com. Termination does not entitle you to a refund except as expressly provided in our Refund & Returns Policy.

11. Disclaimers

THE SERVICES, SITE, AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the maximum extent permitted by applicable law, SASProductions LLC disclaims all warranties, express or implied, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement
  • Warranties that the Site will be uninterrupted, error-free, secure, or free of viruses or harmful components
  • Warranties regarding the accuracy, reliability, or completeness of any information on the Site
  • Warranties regarding products beyond those expressly stated in our Warranty Policy

No advice or information, whether oral or written, obtained from us or through the Services shall create any warranty not expressly stated in these Terms.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such cases, our liability is limited to the maximum extent permitted by law.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SASPRODUCTIONS LLC, ITS OFFICERS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, AFFILIATES, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, exemplary, or punitive damages
  • Loss of profits, revenue, business, data, goodwill, or other intangible losses
  • Damages arising from unauthorized access to or alteration of your transmissions or data
  • Damages arising from any conduct of third parties on the Services
  • Damages arising from your use of, or inability to use, the Services

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100.00 USD).

This limitation applies regardless of the legal theory (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the limitation of incidental or consequential damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless SASProductions LLC, its officers, members, managers, employees, agents, affiliates, suppliers, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorney's fees) arising out of or relating to:

  • Your violation of these Terms or any incorporated policy
  • Your violation of any applicable law or regulation
  • Your User Content
  • Your misuse of any product purchased from us
  • Your infringement of any third-party rights, including intellectual property rights
  • Any claim by a third party arising from your use of the Services

14. Governing law and jurisdiction

These Terms and any dispute arising out of or relating to these Terms or the Services shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of laws principles.

You agree that any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Wake County, North Carolina, and you consent to the personal jurisdiction and venue of such courts.

If you are a consumer located in the European Union, United Kingdom, or other jurisdictions where consumer protection law grants you the right to bring proceedings in your local courts, this section does not limit those rights.

15. Dispute resolution and arbitration

15.1 Informal resolution

Before filing any formal legal claim, you agree to first contact us at support@shootingastargear.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days of receiving your notice.

15.2 Binding arbitration (US customers)

If informal resolution fails, any dispute arising out of or relating to these Terms or the Services shall be resolved through binding individual arbitration, conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in Wake County, North Carolina, or remotely if agreed by both parties.

You agree that:

  • Arbitration will be conducted on an individual basis, not as a class, collective, or representative action
  • The arbitrator's decision is final and binding
  • Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the Services
  • Either party may bring claims in small claims court if eligible

15.3 Class action waiver

YOU AND SASPRODUCTIONS LLC AGREE THAT ANY DISPUTE WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND THAT NEITHER PARTY MAY BRING A CLAIM AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

15.4 Opt-out

You may opt out of the arbitration agreement in Section 15.2 and the class action waiver in Section 15.3 by sending written notice to support@shootingastargear.com within 30 days of first agreeing to these Terms. Your notice must include your name, address, email, and a clear statement that you wish to opt out of arbitration.

16. Force majeure

We shall not be liable for any failure or delay in performance under these Terms due to causes beyond our reasonable control, including but not limited to:

  • Acts of God, natural disasters, pandemics, or epidemics
  • War, terrorism, riots, civil unrest, or government action
  • Labor disputes, strikes, or shortages
  • Power, internet, or telecommunications failures
  • Supply chain disruptions or carrier delays
  • Cyberattacks or security incidents

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving the original intent.

18. Entire agreement

These Terms, together with our Privacy Policy, Refund & Returns Policy, Shipping Policy, Warranty Policy, and any other agreements or notices we provide, constitute the entire agreement between you and SASProductions LLC regarding the Services and supersede all prior agreements, understandings, and communications.

19. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms at any time without notice or consent.

20. Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or our right to enforce it in the future.

21. Notices

22. Changes to these Terms

We reserve the right to modify these Terms at any time. The "Last updated" date at the top reflects the most recent revision. Material changes will be communicated via the Site or by email. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

If you do not agree to the revised Terms, you must stop using the Services and may close your account.
